Legal Question in Family Law in Tennessee
adoption
My daughter just turned 18 and has
found her birth mother (C.K.). At the
time of the adoption my now
ex-husband and I did everything as
instructed by our attorney. The birth
mother is now trying to prove that
she was not made aware of the time
frame in which she could have
''reclaimed'' her parental rights. It
was a closed adoption. My daughter
called this morning and asked for
the names of the delivery doctor and
the birth mom's attorney - neither of
which she (C.K.) remembered. Does
this sound like something that she
can legally pursue?

Re: adoption
You need to actually directly consult with an attorney if you have some questions, because much more information is required to allow a complete answer. If you would like to call to speak with me over the phone, my office number should be listed on my profile here.
But more importantly, whether anyone can pursue "undoing" or setting aside the adoption or not would seem to be relatively unimportant.
If the birth mother and the child wish to re-establish the formal, legal relationship of parent and child, the birth mother and child could not go thru an adult adoption to accomplish that, and there would be nothing you could do to prevent it and it would be much less expensive for the mother than fighting to set aside an adoption.
If the birth mother and the now adult child wish to informally re-establish an interpersonal relationship akin to that of mother and daughter, there is also nothing you can do about it.
Your daughter is now an adult and is no free to do as she pleases. Get used to it.
