Adoption of grandson

My daughter and the father have had many drug problems and both have been in prison in Ca. The daughter has been incarcerated since the beginning of the year. Nick is 8 years old and is in intense therapy because of the trama he has suffered. He does not want to go back to his parents.

I'm sure I can get a signature from the mother but the father is on drugs now and is being sought after for support on 4 other children. What are the steps that need to be taken? The 8 year old has lived with me for the past 3 and 1/2 years. I have completed the parenting classes necessary, and have been with him for all of his thearpy. I'm afraid the other grandmother will try to take him away even though he doesnt know her nor his father ,the last time he saw him he was about 3 years old. Thank you for your time.

I always recommend that anyone going into court obtain a lawyer if at all possible. If you simply cannot afford one please go to your local juvenile court and see if there is a counselor or someone who can talk to you about getting an order of protective custody based upon dependency and neglect. Based upon everything you have stated in your post, this should not be a very difficult process for you. I think you will find that you do not have to give notice to the paternal grandparents.
