Legal Question in Family Law in Tennessee

Adultery and Divorce

My boyfriend and I started seeing each other after he had left his wife and asked for a divorce. She moved back to Texas shortly after he left her. We have since moved in together and are very happy. However, his lawyer is now stating that we should stop seeing each other until after the divorce is final because it is considered adultery.

How harsh would a judge look at a case of adultery when the relationship didn't develope until after the couple were separated and living in different states? They have been apart 02/13/01 to present date (01/06/02).

Re: Adultery and Divorce

It is adultery to have sexual relations with a married person other than your spouse. Under Tennessee law, most judges give some consideration to the fact that the relationship developes after the divorce is filed but the relationship can still cause legal problems. The best legal advice is to not have a sexual relationship until after the divorce is finalized.
