Asset division concerning special circumstances
I have a very confusing situation.I have been married for three years.This is my second marriage,his third.I still have dependent children,he does not.At the time we were married,we were both employed.Approximately a year and a half ago,I was injured in an automobile accident.I have hired an attorney and have been treated by many doctors.I am still unable to return to work.Ever since the accident,the marriage has deteriorated with strong consitency.Many reasons are those which are listed as reasonable grounds for divorce in this state.Such as,mental,verbal and physical abuse,extremely excessive abuse of alcohol,and I believe adultery,but can't prove that one yet.He has specifically told me the reason he is still here is because of the settlement that will come.He is also planning to lie in our depositions in Jan. and says if I contradict him,he'll lie the other way to hurt the suit.I cannot leave because I've not worked in so long.I have no access at all to his money.He's self employed and I don't even know how much he makes.When dividing assets,will a judge take into acct. why and where the money from the suit came from,and the fact that it has to compensate my future inability to work?

You need to be aware that it is legal in Tennessee to record any conversation to which you are a party (more on this at my website at http://www.jesbeard.com/16.htm )
Then record the sorry SOB pretending to be your husband, and get him on tape saying what he is going to do.
Then get the tape to your attorney and let your attorney decide what to do with it.... like let your hubby know that he needs to straighten up or get charged with perjury and extortion.
