Legal Question in Family Law in Tennessee

Atty. Client relationship and repersentation

I have an atty. that has repersented my on a few occasion and has been my divorce atty. I am now remarried and my new husband's ex-wife has now hired my atty to represent her in a child support case. Can she legally represent her in court being that she was my atty.? I do not think the atty. is even aware of the situation.

Re: Atty. Client relationship and repersentation

The attorney could represent your husband's ex-wife without any conflict of interest, but if she and your husband have any children who are still minors, the attorney might decide not to represent her if it is brought to the attorney's attention.

There is no conflict in the attorney representing your husband's ex on an unrelated matter, but if there are minor children and your husband and his ex end up going to court over it, the attorney would be very well-advised to represent none of you.
