back child support

my brother has been served papers for child support by the state for child support that has never been paid, he has never been allowed to see the child, the mother moved out of state, before baby was born. is he obligated to pay. and will he serve jail time for this or can he make payments. what steps should he take. would it be easier to make arrangements before his court date in april. please help he lives in tennessee.

I cannot speak for Tennessee law, but in Kentucky, child support and visitation are considered separate issues. Therefore, the absence of visits will not be an excuse for lack of paying child support. In Kentucky, he would be at high risk for going to jail. His best course of action is to pay what he was ordered to pay - even if he cannot pay the whole amount owed, he should start paying what he can.
