birth certificate change

my brother in law has a son in tennesse and he lives in florida. he had a court ordered paternity test and it is his child. how can he change the child's last name on the birth certificate. also does he have the legal right for visitation when the mother is refusing?

The father (your bother-in-law) can have the child's last name changed in Juvenile Court at the same time the child is legitimated. He also can get an order in Juvenile COurt for visitation with the child and have the mother charged with contempt if she then refuses to allow it.

But these are things he is almost certainly going to need an attorney to do, particularly when he does not even live in the state.

If he truly wants to play a meaningful role in the child's life he also should move to Tennessee to be close enough to do so.
