Legal Question in Family Law in Tennessee
breach of contract
I sent in a question 19/08 but have not yet received a response other than the message my question was received. My question was about my daughters situation. She was a single mother and had saved up $10,000. This police officer swept her off her feet and they go married after dating about 7 months. He wanted to buy a house and she put down $5,000. She used the other $5,000 on the wedding. He decided after 4 weeks he wants a divorce because they are too different but won't give any real reason. His credit was terrible and hers was good at the beginning of the marriage. He now gives her only a forth of their combined bills. Does she have any recourse? Can she sue for breach of contract? If they were to put their house on the market they would loose about $15,000 between fees and the drop in housing prices. She is devastated both emotionally and financially and her little boy is confused and hurt. He still talks about his new step dad all the time. Will she have any problems because he is a police officer in Alsoa? Please answer this question, because she doesn't know what to do. She doesn't have money left for a pricey lawyer and he has two friends that are lawyers, but not divorce lawyers?

Re: breach of contract
Your daughter has learned a tough expensive, and heart breaking lesson. From the information you provided the only course of action for her is to file for divorce and let the judge sort out the financial and probperty issues. Of course, your daughter can file for bankruptcy to get a fresh start financially.
