Breech of Contract Adoption Law

When my husband and I adopted our daughter, we signed a contract with certain stipulations the agency had in place along with some requests from the birth parents. These included raising her in a Christian home with moral values, me staying at home until she went to school, giving her a college education. After a 24 yr marriage, my daughter discovered that her father was involved in several affairs as well as porn, including child porn. Does she have ground to sue for breech of contract, since he will not pay for her college, and refused to give her the college bonds that were purchased for her? I had a son 2 yrs after adopting her and he got no help with college either. Their fathers work will give them 1500 per yr per child and he will not even get that for them. He is however paying for his new wifes daughter to go to college as well as supporting her illigemate baby. But will do nothing for his own kids. I know his son can not do anything, but he does have a contract with the agency to give his daughter a college education. What can she do? He chose to be her father and made promises to her birth parents as well as the adoption agency. The state required state min. of 32% child support and the judge made it 11%.

Since your daughter was not a party to the original contract you would have to assert that she was an identifiable third-party beneficiary. You need a lawyer to help you, there's not much more I can tell you over an internet exchange.
