Legal Question in Family Law in Tennessee

change of jurisdiction

My husband and his ex-wife were divorced in Oklahoma. She and the kids have lived in Tennessee for two years. Oklahoma law requires the non-custodial parent's income to increase by 25% before the other party can ask for increased support. Tennessee however, only requires the income to increase by 15%. His ex-wife wants to change the jurisdiction to Tennessee so she can go ahead and ask for an increase. His pay has only increase 16 or 17%. Can she do this just to avoid the unfavorable law in Oklahoma?

The key here is the state in which your husband currently lives. Jurisdiction would be in that state, unless OK law (with which I am not familiar) has some law allowing its courts to retain jurisdiction. Unless your husband lives in TN, I do not see how any action could be filed in TN.
