Legal Question in Family Law in Tennessee

Changing a Child's Last Name

My Stepson has started saying he has a new last name (since Bio-Mom) married. He is 6 years old. He said his mother changed it.

Stepson was born in Illinois. Bio-Mom and Bio-Dad never married. Son has Bio-Dads last name.

Bio-Dad went to court, established parentage, has visitation, and pays child support. Custody was never specifically stated, not sure if that means Bio-mom has sole custody.

Can Bio-Mom change sons name without Bio-Dad's approval (or even trying to inform him) ?

Isn't this a severe form of PAS ?

Re: Changing a Child's Last Name

It is likely that custody is joint, but review the final judgment to be certain. Bio-mother should not be able to change name without your consent. You are advised to consult with a family law attorney to resolve these issues with mother.
