Legal Question in Family Law in Tennessee
Child Custody
I had a messy divorce and no money to fight for child custody. My ex husbands parents fought with thier money. He won custody without even going before a judge. He is known drug dealer and has now abandoned our son. His parents are now fighting me for custody of my son. They say I have neglected the child and failed to pay child support. I did not know where to send the money cause it was to be to the father and they only let me have him 2 months in the summer. What can I do? Can the grandparents take my child? I have a nice home, and a good job. I can pay now. But I live with another female and we are romantic. Can they take my son from me for that too? Also this is in Tennessee and i live in Texas now. Better job opportunities. Thanks KIm

Re: Child Custody
I agree completely with Mr. Nance and Mr. Reisman. If the case was in Davidson County, would be happy to send you some referrals.
Re: Child Custody
Unfortunately, your romantic relationship with your roommate can be considered (maybe not legally) as some reason for you not to gain custody. Particularly since you're going to have to do this is TN. You know what TN thinks of same sex relationships better than I do. I know it's not right, but it would cost you a *bunch* of money to fight this. If you've got it, go for it. If not, well I'm sorry. That's just the way it is. Not legal - just the way it is.
Re: Child Custody
You really need to hire a family law attorney as soon as possible. The more time the child lives with his grandparents, the less likely you are going to be able to gain custody. There are constitutional issues invovled in your case, namely, your constitutional right to raise your child. Generally speaking, a natural parent has priority over third parties. There are exceptions which a lawyer can explain. Obviously, under the circumstances, you have a complicated case, but the sooner you get a lawyer on this the better. Best of luck to you.
