child custody

I want to know what rights do fathers have to the child when the 2 parents were not married? If one parent doesnt challenge custody, does that mean the other parent has sole custody?

A biological father's right to a child--regardless of marriage--is equal to the mother's. If custody is brought before a court, and the parties have not themselves worked out a custody arrangement, the court will decide custody (sole, joint, primary physical etc.) based upon what is in the best interest of the child. The "best interests" test involves several factors such as income, health, child preference, primary caregiver. If you are involved in a custody action you should consult an attorney to review your particular situation.
