child custody
I have a 14yr old daughter that wants to come and live with me. She is having problems at home with her mother. Her mother is by-polar and has remarried. She complains that her mother is VERY moody and that she argues often with her step-father. I am remarried and have a very stable home life. Is it feasible to go to court and get the custody changed?

Yes, upon a showing of an unanticipated material/substantial change in circumstances the judge has the discretion to change "custody" or parenting time. It is not automatic, but it is certainly possible. Please talk to a local family lawyer about the process. Best of luck.

You may have grounds for a change of custody. In TN you must show that a "material changes of circumstances" has ocurred to warrant a change a custody. The Mother's remarriage and hostile environment could be considered a "material change of circumstances" warranting a change of custody from the Mother to the Father. It's worth a shot.

When a child is twelve years of age or older, the Court can take the preference of the child into consideration. This does not automatically mean custody will be changed, but it is a major factor.
