Child Support

My divorce was final in 1996 which did not include child support arrangements for three children whose current ages are (16, 16 & 13) of which I have custody. My ex started providing support in 2001 which averaged $250. He's currently providing $450 a month, never misses a month and we get along fine. He is self employed, (landscaper, electrician). I have no way of tracking his salary. If I file for child support through the court, would I fair out better than our current arrangement, keeping in mind he may not report his actual income?

That's a wide open question. The answer is maybe. It depends on several variables: your income, his income, how many children he has, how many children you have, if he keeps the children overnight, if you have work related day care, if you or he pay health care premiums, just to name a few. If you are currently receiving state assistance (not just food stamps) you can have the local child support office file a petition to set support in the court where you were divorced. If you are not receiving state assistance you can apply for services, NOT BENEFITS, at the local child support office and have a petition brought by the agency.
