Legal Question in Family Law in Tennessee

Community Property

My wife and I have been separated for over a year with no divorce filed as of yet. I recently discovered that she alledgedly ''non-suited'' me on the Phen-Fen lawsuit as her husband and was told that she gave the money that was supposed to come to me to her son. If I did not personally non-suit this case, can she do it? Would that not be forgery? Also, I understand she got a settlement from this case. With Tennessee being a Community Property State am I or am I not entitled to one-half of her settlement? I would like to start procedures for a divorce, but would like the answers to these questions prior to filing so that I would know what to put on the Marital Dissolution Agreement.

Re: Community Property

First, Tennessee is not a community property state. The rule here is "equitable", which usually means equal. Massive amounts of information would be needed to answer your question. If you wish to give that info, contact me via www.gsmithlawfirm.com .
