Community Property
My wife and I have been separated for over a year with no divorce filed as of yet. I recently discovered that she alledgedly ''non-suited'' me on the Phen-Fen lawsuit as her husband and was told that she gave the money that was supposed to come to me to her son. If I did not personally non-suit this case, can she do it? Would that not be forgery? Also, I understand she got a settlement from this case. With Tennessee being a Community Property State am I or am I not entitled to one-half of her settlement? I would like to start procedures for a divorce, but would like the answers to these questions prior to filing so that I would know what to put on the Marital Dissolution Agreement.
