Legal Question in Family Law in Tennessee
Credit incurred by spouse
My wife has a malignant brain tumor that has caused personality changes, such as inability to reason. She has opened personal credit card accounts. Am I legally responsible to pay these. I certainly can not afford it. She is disabled and has no income.

Re: Credit incurred by spouse
It sounds like your wife is not of sound mind, what the law calls non compos mentos. If you obtain a copy of a doctor's report showing the malignant brain tumor and send it to the credit card companies that bill you, they should cancel the credit cards and cancel her debt. If not, you can use that legal defense to pay any bills, because a non compos mentos person cannot be held liable for contractual obligations. At least that is how a reasonable court should interpret these facts.
