In Kentucky, the issue of child support arrearages and custody do not go hand in hand. Under the right circumstances, a "deadbeat dad" could get custody if it is in the best interest of the child or if the child's welfar is seriously endangered. I would anticipate, though, that a judge will wonder if a dad can provide adequate care for the child in his own home if he could not pay child support when the child was not there.
