Legal Question in Family Law in Tennessee

custody

my mom has temporary custody of my son, the document granting this is not notorized or through a court. She agreed to return him to me when I was able to provide for him. She will not return him to me now. She is getting ready to file for full custody so she can receive a disability check for him. The document clearly states she agrees to return him to me at the time I am able to provide for him, I have repeatedly tried to visit him and get him back. she will not let me have him. If i go get him am I breaking any laws and be arrested for kidnapping? Tennessee is where they reside. I live in Florida.
