want to get custody of 12 yr. old child

12 yr. old wants to stay with dad,local lawyer says have to wait until she is 13. he says because they just increased my child support we have wait,but reason for doing this is,child refuses to go home after a visit,she has expressed a desire to stay. mother will not agree. no child abuse we know of. would like to have joint custody,so child can be free to stay at will or go to mothers for as long as she likes.what can we do? can you help us?

You can file a petition at any time. The court must consider the wishes of a twelve year old, but does not have to follow the child's desires. Good luck.
