My Daughter

I am considering a divorce. My house was purchased before marriage, it is my husband's house. I am unemployed but I do have an employment plan. I want my daughter with me and my son when I leave. What can I do legally to keep her with me? I will be leaving the home soon and I will most likely have to leave the state I currently reside.

Do you plan to get agreement from your husband to the divorce and work out the terms together, or are you going to have a contested divorce? The custody of the children is normally a part of the divorce decree. Separately, you will need to submit a parenting plan to the court on who will have custody and how visitation will be arranged with the noncustodial parent.
