Legal Question in Family Law in Tennessee
divorce decree
In my decree my ex-husband was ordered to pay off $20,000 in credit card debt that he racked up for his computer business. I am also owed the equity in the house that we shared (i have moved out); It was all due by Dec.31, 2005, but he has yet to pay it. I contacted the lawyer who sent him a contempt of court letter; he had 30 days to respond. He did respond on the 30th day thru his lawyer. What is the process now that I will have to go through in order to get him to pay me what he agreed to in the decree? Any idea about length of time?

Re: divorce decree
Unfortunately you are going to have to file a post-divorce Petition For Contempt against him for failing to comly with the Court's Order/Decree. It will be served on him and he'll have 30 days to respond to the allegations of contempt contained in the Petition. Some Courts will let you do it by a "show-cause" proceeding, where as other Courts will just set it for hearing sometime after 30 days. You should get your divorce attorney to do that for you.
