Legal Question in Family Law in Tennessee
divorce
If I get a supeona to a divorce trial (not
mine) do I have to go and do I have to
answer? There have been no laws
broken and the divorce is not
contested.

Re: divorce
Generally speaking, if you receive a properly issued and properly served subpoena, you must comply. There are exceptions. One exception is if you are statutorily immune from the subpoena. Another exception deals with distance requirements. I encourage you to obtain counsel and discuss whether you are required to attend and why. It makes no sense to me why you would be summoned to attend an uncontested divorce hearing. Your second question was whether you have to answer. I assume you are asking if you have to answer questions asked of you on the witness stand. Again, an attorney can tell you what questions are objectionable and which ones are not. If an attorney is in court with you, the attorney may be allowed to make objections on your behalf. Please consult with legal counsel about this.
