Legal Question in Family Law in Tennessee
Divorce w/ Huband in Jail
I have been separate for 8 yrs in May. I left him when he was living in Georgia and I moved myself and daughter to Florida. He now lives in Nashville and is not on the up and up. He is in jail for either another DUI or writing bad checks again. He has been in jail for fraud or something like that when he stole my brother's checks when we lived in Georgia. I have tried to divorce him on 2 occasions where I have paid for everything and he never showed up to sign the papers. He says that he is ''working''. He brought some do-it-yourself papers last Year (9-04) and I signed them, but when I went to call the counties that they might have been processed thru, guess what! No papers have been filed. I want this nightmare to end. I have moved on and I just need to get this over with. Our daughter deserves stability. She is almost 9 and we agreed on an amt of $350.00 for child support. You guessed it! he can't even keep up with that. His family is in denial and I refuse to let anyone from that side be around her. I have higher morals than what he has done. Please guide me or help me figure out what I need to do next. I would like to be able to serve him in jail since I know he will be in there until May 19th. Thank you for assistance.

Re: Divorce w/ Huband in Jail
Since he resides in Tenn. you must proceed there. Florida has no jurisdiction over him.
