Legal Question in Family Law in Tennessee

Father Refuses Visitation/consequences

My Sons Father never exercises visitation unless it is convenient for him. Even if he is supposed to get our Sons if his girlfriend and him plan something, then he does just that, does not keep in account that he is supposed to be sharing this time with his sons. I know that one day he will regret this maybe, but is there legally anyway that I can financialy deem him for this. He does not help with child care neither and I have to bear all of these expenses. He is also very behind on child support. any suggestions?

Re: Father Refuses Visitation/consequences

The current TN child support guidelines allow you to seek an upper deviation in child support where the non-custodial parent does not visit a certain number of days per year. You will want to be able to show how much more it costs you because of this.

As for the back child support, you might want to consider speaking with an attorney about a contempt petition.

As for the child care, I believe you will find that you are responsible for that when the child is with you and he is responsible when the child is with him. Since he does not visit that is one of the ways you are going to be able to support your case for an upper deviation.
