Fathers rights

I have a 2 yr old son with a woman I never married. I pay support and have insurance coverage on my son. I see alot of him but she is starting to keep him away from me more and more. she wants to take hime to Tx for a week, I don't think it is safe to drive with 2 kids and a dog. do I have the right to say no. We have never been to court for custody. She stays home with the kids and doesn't work. What are my rights

Before I answer your question, let me pose this question to you. If you were the custodial parent of your child and you wanted to take a trip to Tx with the child would you want the non-custodial parent(mother) to tell you, you couldn't go.

I don't believe a judge would tell the mother she couldn't take her children to visit in Texas.

Regarding the other issue of visitation, I would file a petition to set visitation. This would solve any problems with visitation. But before I did that, I would sit down with the mother and explain to her that you don't want the state getting involved in your visitation and that you would rather work it out between the two of you.

One last piece of advise. Start keeping a diary of the days visited and days you attempted visitation and were refused.
