Re: giving up rights
My questions for you:
Why? What is the motivation?
Is she being adopted? Is he wanting to distance himself from an obligation? What is the reason behind his wanting to give up his legal status as her father?
Not knowing the details of your situation, My outsider perspective is--- I can see How the father may benefit from not having any legal obligation to his daughter but what I don't see from the limited information is: How is it the best thing for your daughter?
Termination of Parental rights is not something to be undertaken lightly nor should it be undertaken as a reactionary response. ie...current hostilities or lack of involvement with the child. Additionally, When you consider your request and the basis behind it--How do you anticipate the court will view your request? Just because--is not a ground for termination that the court will consider.
Termination in connection with an adoption or termination when a child is in foster care or in the custody of the state is one thing but just the decision to no longer want the legal obligation is another thing altogether. Has he severely abused his daughter? Has he been convicted of murdering a sibling? Nothing that extreme--still, don't forget---Is the termination of Rights in the best interest of the child? When you think about the answer to that last question--the answer should be framed from the court's perspective-- not-- from the, "My ex (man or woman) is a great big jerk" point-of-view.
