Grandparents custody and rights.

I have a 17 yr. old daughter,8 mth. old granddaughter.My daughter thinks she can come an go as she please an leave the baby here with my wife and myself. The father has visitation everyother weekend. Is there any way for my wife and I to get custody of the baby until our daughter gets her head on straight? I have raised my granddaughter since she was born and paid all bills. Please help if you can.

It sounds like you are more interested in controlling your daughter than in the welfare of the grandchild... and it sounds as if you lost control of her at least nine months before the child was born....

Now, to answer the precise question you raised, you would need to establish that both of the child's parents were unfit, that there was a "substantial risk of substantial harm to the child" if the child was placed with either parent before a court could properly remove the child and place the child with you or with anyone other than a parent.
