Legal Question in Family Law in Tennessee

Grounds for Divorce

I started seeing a guy shortly after his wife filed for divorce on the grounds of mental abuse. He was made to leave the home, which is in both their names, she still has the majority of the marital property, and is not allowed to return to the home or get his property until the court date. Can I see him legally before the divorce is final, and/or will it cause him to lose his property? They have no children. Can she change the grounds for divorce?

Re: Grounds for Divorce

A party filing for divorce can amend the complaint to seek the divorce on other grounds, but under Tennessee law, fault is not SUPPOSED to be a factor in dividing marital property, however judges are human beings and emotion does sometimes play a role.

Money spent of girlfriends or boyfriends, however, can be considered a waste of marital assets and the spouse spending money this way can be foreced to reimburse the other spouse.
