how to handle a newly purchased home in a divorce

I am getting a divorce. My Dad furnished the down payment. My husband put in the $4000 closing cost. My husband will agree to the divorce if he gets his money back. Is it possible to take my husband's name off the mortage (with his permission) and put my Dad on, without having to pay closing costs again? Is that what a Quick Claim is? We've only been in the house 4 months.

It is possible but unlikely that the mortgage company would agree simply to substitute your father for your husband. On the other hand, if your father is a better credit risk they might be agreeable to redoing the whole mortgage. You have nothing to lose by asking the mortgage company.
