Issue with Lawyer
I have signed a contract I suppose, with a lawyer stating, among other things, that his fee will be 1500 dollars for working out a parenting plan etc between myself and my ex. I paid an initial down payment that was required, and asked how I should pay in the future and how long he expected this to take. I had every intention of paying monthly if not weekly installments, so long as he was actually working on my case and making progress. I was told that it would most likely take no more than a month to get in court and get a resolution.That was 2 months ago, and I cannot get him to call me back, or even find out if there has been any progress what so ever. He will not return calls, is never 'in the office' and according to his secretary she indicates to me that there has been no progress on my case? Am I obligated to fulfill this contract with this Lawyer? Its not about paying,,I will pay, but I dont think I should have to pay if hes not even going to work on my case!! No progress for 2 months, no returned phone calls,,nothing,,,,Help!!!

Send the lawyer a hand-delivered letter and a fax (if you have a fax machine through your computer at home) stating that he has not returned your calls, which is an ethical violation for the conduct of attorneys, and he is far behind in his work on your case. You intend to fire him and seek new counsel if he does not respond within 7 days. If you are forced to fire him, all financial obligation to the lawyer will stop. Put that in your letter. Either he will smarten up and respond, or you have found a stereotypical lazy lawyer who bleeds clients for money and does little or no work.
