Kicked out of the house

On 9-28-06 I recieved a final decree stating that my child and I had to be out of our home by 10-1-06, FOUR days! I understand that it will be 30 days before the order is final and a motion to reconsider &/or new trial has been filed on 9-29-06. I have no money and my husband was awarded every financial asset. It looks like the ''projects''. How long do I have before I have to move? Will I recieve an eviction notice? Can ''they'' kick us out on the street? My husband makes almost $100k per year and I have been saddled with $65k+ debt with an imputed income of $13k per year.

If you do not have a divorce lawyer, get one NOW! If you do have one, perhaps speak with him or her about filing a notice of appeal with the Court of Appeals and asking the trial court to stay (halt) the execution of the judgment until the appeal has been decided. Consider putting on proof that you will be homeless or bound for government assistance if the judgement is not stayed. If the Motion is denied, then consider asking the Court of Appeals to review the denial of the Stay request. Obviously, if you don't have grounds for an appeal the lawyer will tell you. By all means get legal advice as soon as possible. Your lawyer will advise you about your requirement to follow final court orders and about the proper manner to preserve an appeal and all post trial motions which can be filed. Best of luck.
