Legal Question in Family Law in Tennessee

Leaving the state with my child

I have been told that I cannot leave the state of Tennessee, or go more than 100 miles with my 4 year old daughter. No divorce has been filed, no legal separation, no custody agreement. I want to move back to my hometown in Mississippi to live with my mother until the divorce is completed. Is it true that I cannot go more than 100 miles from my home in Tennessee??? I can move to Memphis with my father until things are settled, that is about 130 miles away.

Unless a judge has told you that, that is not exactly true. We have a law in TN caled the "relocation statute" or the "move away" statute and it is possible, and if fact, likely you will need to follow the requirements of that statute in your attempt to relocate with your child, but to say it is impossible to do so is incorrect. Really it depends on the circumstances and I urge you to speak with a family law attorney in your area to discuss whether the relocation statute applies to your situatio and if so, the lawyer will tell you how to handle the situation.
