Legal Question in Family Law in Tennessee
Mistake on divorce papers
My husband and his ex filled out there papers w/o an attorney. The mother checked the box MOTHER will pay child support in the amount of $65 weekly. Child support officials are trying to charge my husband with contempt for not paying when he was unemployed. My husband is not disputing that he owes child support but can he be charged with contempt when there is no official court order stating that FATHER will pay due to the mistake in the divorce papers? Also can the mother be charged with contempt if she has not fullfilled some finicial obligations listed in the divorce that are now on my husabnds credit record as bad debt?

Re: Mistake on divorce papers
Rather than answer this question, I think you can see where his first mistake was- signing a legal document without legal counsel. Please do not let him make that mistake again. Help him find a good attorney in your area to straighten this situation out. Time is of the essence, because next month he will owe the higher amount again.
