Moving

I have full custody and I want to move out of state. I want to know what legal rights I have to do so without getting in trouble with the court. The father has visitation rights. The father pays regular sometimes, and sometimes he doesn't. There is no way for us to work out a plan between us.

TCA 36-6-108 pretty much spells it out. As long as your reason for moving is not to deprive your child's father of visitation all you need is a valid reason (under a recent opinion it might be enough to just want a change of scenery.) At least 60 days before you move you have to give him written notice - rather than take your time putting it down here, you might try going to one of the websites which has a jumplink to the Tennessee Code. Dig up 36-6-108 and read it carefully. An agreement is best and less expensive than litigation. Part (b) appears to provide for an informal agreement but it would be far safer to have an attorney obtain the court's approval.
