Legal Question in Family Law in Tennessee

My neice and great nephew

My neice has a 3 year old son with her live in boyfriend. She is on probation and has been violated and is going back to jail (at least for a while) I know in TN that since she was not married to him to my understanding she has sole custody. However she doesn't want the state to take her son from his father too when they arrest her on the impending warrant. Can she just do a notarized statement giving him temporary custody or does she need a power of attorney? PLEASE HELP--WE NEED TO DO THIS SOON!

Does the child carry his last name, is he on the birth certificate. They can file an agreed order of parentage giving them joint custody
