noncustodial parents rights when custodial parent abandons child
My exhusband got custody of my daughter at the time of our divorce. He later remarries, then gets divorced again and leaves my daughter with his new exwife. He has moved to another state and has not even called my daughter in 4 months.He has abandonded her. Do I have the right as her real mother to go and get her? I want custody of her but my attorny tells me that her step-mother can get me for kidnapping if I go get her. What do I do? her father has been gone for 4 months with no contact with her at all.She wants to live with me. What is the best thing for me to do? Can I get custody?

I would have to know more as to why such an act would be kidnapping. What does your custody decree say? Does the stepmother have legal custody? You could at least file a petition to seek whatever rights you desire. Good luck.
