Non-established paternity in child support case
The state is suing me for child support on a child born 10/1988. I have not had contact with the mother since 7/1997, though she listed me on the birth certificate. I have informed social services of this and offered to take a paternity test to prove/disprove my claim. The child has been in state custody for over 1 year. Now I have been served with a summons. What are my rights and what discourse do I have concerning this issue? Your help is greatly appreciated.

I am not exactly sure what type of proceding you are facing. You need a lawyer to look at the papers. This is very serious because if you are ordered to pay child support back to '88, that could be devistating depending on the circumstances. Do not try to handle this without a lawyer. You may waive your right for a paternity test if you do not ask for it right away. Also, if the child is yours and the court is inclined to award back child support, have all your income info available back to '88 because most people's income increases over time and you do not want the court to set the back child support at the current/higher income level.
