If your divorce decree provides for custody, then that decree will control in most cases. If you were awarded custody, and the Father refuses to return the child then you may have a legal remedy here in Arizona; however, if Father was awarded custody and both Father and child have resided in New Mexico for more than six months, the New Mexico may be the jurisdiction for custody disputes, as New Mexico will have become the child's home state after six months residency.
