How do I obtain custody of my son who was put in foster care?

My son is 6. Until 7mo ago I didn't know where he was. My x remarried & skipped town. I finally found her. I tried to be a part of my son's life. She made excuses why he was never home Then she told me he has been in foster care for 10 mo. I petitioned the court for custody. DCS filed petition to give custody back to my x(even though she hadn't had a job for 10 months). My son has ODD. His Dr. said not to move him until he finishes a program to get him back in reg school (he failed Kindergarden b/c of his violent actions The judge gave me monthly visits & weekly phone calls & ordered my son stay in foster care until he finished the program. I want custody. The foster parents have are interested in adopting. Could the judge grant them custody? My ex said that I am abusive. They are lies & she has no proof(my background checks came back clean).My home study said I would be a good placement. The day after my visit he ran away from his foster mother. The cops were called & couldn't find him for 3 hr. How do I show the court that my home is best. Every time I see him he wants to come home with me.

You need to get an attorney who knows what he is doing, and if the child's paternity has been established you can ask the court to appoint an attorney for you if you can't afford one.
