You both could pay attorneys to have that issue resolved before a judge, or you can agree. 1) Where does the child want to play? 2) How much of an inconvenience would it be to have the child play for the other spouse suggests? Try to look to the best interest of the child, not the adults. 3) Is this the ONLY issue? Check witht the child first. 4) Where would the child play if there were no adults; or only one adult. Playing softball may not be that big of a deal. See if there are other activites the child would be interested in that you two agree upon. You see, there are lots of alternatives. Remember, it's for the child. Not the adults.

The answer to your question probably depends on the language of the final decree of divorce/parenting plan. If one party was awarded "custody" and there are no provisions for extracurricular activities such as softball, the custodial parent is likely going to be able to make this decision unless the court gets involved. If the divorce was within the last couple of years, extracurricular activities should have been addressed in the parenting plan, so please go back and look.
