Legal Question in Family Law in Tennessee
Paying for College
My daughter is 19. She went to a community college in the spring and took 2 classes which her Dad and I split the cost of. She dropped out of both classes. She would like to go back in the fall and try again. The divorce decree states her father and I will split the cost of college. Her father says he will not pay since she dropped out of the 2 spring classes. Can I force him or will the court force him to pay? If you think the court will force him to pay and I take him back to court, will he have to pay my court costs? Thank you for your time and assistance.

Re: Paying for College
You need to review the Final Decree of Divorce and Parenting Plan or Marital Dissolution agreement to make sure you daughter is not required to maintain a certain grade ie "C" or better. It she is then I think he may be off the hook. If not, you could take him back to court. If you prevail, you should get your atty fees and court cost paid by your ex.
