Legal Question in Family Law in Tennessee

Who pays for the Medication?

I have co-parenting of my son. I pay child support weekly.

The parenting plan states unpaid medical bills will be split between me and my ex-wife. She is now asking me to pay 1/2 of his co-pays and 1/2 of his medication from the pharmacy. Do I have to pay this?

Re: Who pays for the Medication?

YOU HAVE TO DO WHATEVER THE PARENTING PLAN SAYS. REVIEW YOURS AND SEE EXACTLY WHAT CONSTITUTES "UNCOVERED MEDICAL" BILLS. I CAN TELL YOU THOUGH THAT MOST DOMESTIC COURTS HOLD THAT "UNCOVERED MEDICAL BILLS" INCLUDES THE CO-PAYS AND DEDUCTIBLES AND ANY OTHER COSTS NOT COVERED BY INSURANCE.

Re: Who pays for the Medication?

1/2 of medical bills means 1/2 of uncovered medical bills including doctor's visits and prescriptions. This gerally means the residential parent is to send a copy of the paid or unpaid medical bill to the alternative parent with in 30 days of receipt of bill or payment. The alternative parent then is to either pay the provider 1/2 of the bill or pay 1/2 of the bill the residential parent has already paid. If the alternative parent who is ordered to pay does not pay, the residential parent can then file a contempt petition for the alternative parent's failure to pay.
