Pullind rights

My daughters father has been in jail the majority of her 3 year life we never had child support or visitation set-up. She has his last name and he is on the birth certificate. He is presently in jail, she has been to see him occasionaly with his parents. When he is out he hasnt anything to do with her, he only see's her when at his parents house. Is there any way I can pull his rights. My husband now for a little over a year would like to adopt. Is there anything I can do.

If your husband is interested in adopting, yould could file a petition to terminate parental rights and adoption. I would consult an attorney.
