A Question on Divorce

A good friend of mine is seeking a divorce from her husband of almost 9 years. They have not lived together for 8 years of their 9 year marriage due to his repeated incarceration both in jail and prison and his abuse of crack cocaine. He is not contesting the divorce and is currently in state custody for felony charges. They have no property or children together.It is a totally uncontested divorce. she purchased a kit to do the divorce herself and has all of the paperwork filled out.The next stpe is to get it all notarized and filed. Is she required by Tennessee state law to hire an attorney to complete the divorce process? Thank you for your help.

No. she has a right to represent herself in her divorce. I know very little about such kits. But I do know that more often than not, when I see people try to do this on their own, there is at least one thing they do not get right (usually more than one thing) and they have to start over. If the matter is truly uncontested, she will probably be able to find a competent lawyer who will do this right for her the first time and it will be worth the money to be divorced from this "gentleman."

No, your friend is no more required to hire an attorney to get her divorce than she is to hire a dentist to have dental work done.... but if she does not have an attorney she may well end up with problems she can not forsee, possibly including nor even actually being divorced.
