Legal Question in Family Law in Tennessee

What happens if I refuse to sign the papers

What happens if I refuse to sign the papers. My wife wants her name of the mortgage of a house we just purchased in December 2004. She doesn't want the house but I do. I don't make enough to refinance it myself and I would prefer not to sell it. Is there another solution?

Thanks for your time and effort.

Re: What happens if I refuse to sign the papers

Although there are some legal issues involved, sounds more like a disagreement among husband and wife.

If your wife signed the documents making her jointly liable for the debt, she is on the hook for the loan until she is released by the financial instituion or by securing another loan.

If release by the finiancial instituion is out and refinancing is out, selling the property is anothe option.

Try getting your wife released from the debt first. I can assist you with that.

The house may not be the problem. I'd try to determine what the real problem is .... and work on that.

If all fails and you still need an attorney for whatever reason, call me 423 266-4855
