Legal Question in Family Law in Tennessee
Getting remarried have kids, what about child support?
I am divorced and recently about to
remarry. My ex-husband pays child-
support, though never on time and
owes a back amount. After I am re-
married, will the child support he
owes be lessoned since I am now re-
married and together we now have a
larger income?
Also, is it possible for my future
husband to adopt my 2 children.
They are incredibly close to their
future Step-father and have had NO
contact with their biological father.
He does not call or write or visit,
though I have gone to his state w/
the children so they could, he never
did. We try calling him but he never
calls back. Apart from sending his
rare payments he has no contact. I
have full custody of both children and
he has the right for visitation, but in
3 years has never done so.
What if he will not agree to the
adoption?

Re: Getting remarried have kids, what about child support?
The child support he already owes will not change. If your income goes up, the biological father may be able to petition the court to reduce support but there are a number of factors involved. A step-parent adoption is possible and there are a number of routes to accomplish this depending on whether consent of the father is possible. Contact an attorney to consult on the specifics of your case.
