My rights as a parent
My wife made up a lie saying that I hit her; in order, for her to be able to stop me from seeing my son. She has only allowed me to see him 2 days a week for 8 hours each, and is now trying to take one of those days away to put him in day care that the state is paying for, and she does not need this daycare because I work the opposite shift and could watch him. My question is since her and I are not devorced can she put him day care at the states expence when I am off when she works.

What the state will or will not pay for would seem to be a very minor concern in your case. You don't indicate whether a court has or hasn't gotten involved yet -- whether the limitations on your time with the child are a result simply of the mother SAYING that is all she will allow, or whether a COURT has ordered it. If there is no court order involved and you and the mother are married, you have as much right to be with and make decisions involving the child as she does.
