What rights does a unwed father have ?
My brother and his girlfriend had a baby, the baby took my brothers last name, now she is refusing to let him or his family see the baby. The baby is 5 months old. She says she can have the baby's last name changed. Does'nt my brother have to give his consent since he signed the birth certificate? My brother is in jail right now, So what is my mother's rights for getting to see my nephew?

Tennessee's legislature tried just this past legislative session to pass another "Grandparent's Visitation" statute, and under it the grandparents might be able to get a court to order visitation, though I suspect that Tennessee's Supreme Court will declare the new statute unconstitutionally interferes with the right of a parent to raise a child as the parent sees fit.... just as the Tennessee Supreme Court has done with the last tow Grandparent Visitation statutes.
